Terms and Conditions for Collections and Deliveries
1. Introduction
These Terms and Conditions (“Agreement”) govern the collections and deliveries performed by MacRoots (Pty) Ltd (“MacRoots”, “we”, “us”, or “our”) for our customers (“you” or “your”). By scheduling a collection or delivery with MacRoots, you agree to these terms and conditions.
2. General Information
- Nationwide Service: MacRoots offers nationwide delivery and collection services, with deliveries originating from Gauteng. Delivery fees may vary depending on the delivery location and urgency.
- Exclusions: MacRoots reserves the right to refuse or decline any delivery or collection request at its discretion, particularly in cases where the area poses a safety risk to our driver. MacRoots will not deliver to or collect from areas deemed unsafe.
3. Scheduling and Timing
- Standard Deliveries: Deliveries are scheduled a minimum of 24 hours in advance.
- Next Day Deliveries: Next day delivery requests must be made before 4:00 PM on the day prior to the required delivery date.
- Same-Day Deliveries: Same-day delivery requests may be accommodated depending on the time the request is made but cannot be guaranteed.
- Delivery Hours: Deliveries are scheduled between 9:00 AM and 4:00 PM, Monday to Friday, excluding Public Holidays and weekends (Saturday and Sunday).
4. Rescheduling and Cancellations
- Rescheduling: Any request to reschedule a delivery must be made at least 24 hours in advance.
- Missed Deliveries: If no one is available to accept the delivery as scheduled, the delivery will be cancelled. A redelivery fee will apply if a second attempt is needed.
- Driver Wait Time: Drivers will wait a maximum of 10 minutes at the delivery address before leaving.
- Cancellation: If a customer cancels the delivery last minute and the driver has left the MacRoots office, the delivery fee will still be charged.
5. Delivery Costs and Payment
- Delivery Fees: Delivery fees vary based on the location and urgency of the delivery. Customers may request a quotation for the updated fees.
- Payment Terms: Payment for deliveries is required upfront before a delivery can be scheduled. Customers without a MacRoots account must pay via EFT prior to the delivery being scheduled. Customers with existing accounts may follow their standard account terms and payment methods.
- No COD for Deliveries: Cash on Delivery (COD) is not accepted for deliveries.
6. Delivery and Collection Handling
- Eligible Items: MacRoots will only collect and deliver ICT equipment that is deemed safe to transport in our delivery van. Any items not deemed safe for transport will not be collected or delivered.
- Damaged or Missing Items: In the event of any damages or missing items, MacRoots does not accept liability. Customers should inspect their items at the time of delivery and report any issues immediately to MacRoots.
7. Access to Delivery Locations
- Complex/Business Park Access: If access to a complex or business park is required, you must provide the necessary security access information in advance, including access codes, one-time PINs, informed security personnel, and contact numbers (primary and alternate) to allow for successful delivery.
8. Acceptance of Deliveries
- Signature Required: All deliveries must be signed for by the recipient. The person receiving the delivery must fill in their name, surname and signature on the Proof of Delivery (POD) and Delivery Register.
- Alternative Recipient: If someone other than the person who scheduled the delivery is accepting the delivery, the full details of the alternative recipient must be provided at the time of scheduling.
- Waiver of Claims: If the delivery is not signed for and an issue arises, the receiver waives any rights or claims against MacRoots. No exceptions will be made to this condition.
9. Split Deliveries
- No Additional Fees for Split Deliveries: If an order requires a split delivery, the second delivery will not incur an additional delivery fee, provided that the split delivery has been arranged and confirmed with MacRoots’ Helpdesk.
10. Late Deliveries and Unforeseen Circumstances
- Delivery Delays: While MacRoots strives to meet delivery schedules, delivery times may be affected by unforeseen circumstances such as weather, traffic conditions, road damage, or other factors beyond our control. As such, we cannot guarantee exact delivery times.
- Force Majeure: MacRoots will not be held responsible for any delays or inability to deliver due to events outside of our control, including natural disasters, strikes, or any other causes of force majeure.
11. Liability for Damages or Loss
- No Liability for Damages: MacRoots (Pty) Ltd and its employees will not be held responsible for any damages, losses, or liability of any nature, howsoever caused, to data, hardware, or software. The backup of data and software is the responsibility of the customer, as set out in the Data Indemnity Form.
12. Custom Delivery Instructions
- Specific Requests: MacRoots will consider specific delivery instructions, such as particular time preferences or special access requirements, but cannot guarantee compliance. It is the customer’s responsibility to ensure that their delivery request is feasible within the parameters outlined in these Terms and Conditions.
